Liberty [Insurance Co.] Says Texas Law Applies In Sinkhole Suit

Law360, Los Angeles (October 2, 2015, 6:00 PM ET) — Liberty Insurance Underwriters Inc. told a Texas federal court Friday that its battle with Occidental Chemical Corp. and Texas Brine LLC over liability for a massive sinkhole is governed by Texas law because the insureds are based in that state.

In a brief supporting its motion for summary judgment, Liberty said Occidental and Texas Brine are trying to complicate the choice-of-law issue by noting that Texas Brine’s parent company used a broker with a California office . . . .

Vitter, Angelle lay blame for Bayou Corne

BATON ROUGE, La. (AP) – A three-year-old sinkhole that forced 350 rural Louisiana residents from their homes has become a flashpoint in the governor’s race, with Republican candidate David Vitter accusing GOP rival Scott Angelle of running away from the catastrophe.

Angelle was head of the Department of Natural Resources in August 2012 when a swampy area of Assumption Parish dissolved into muck about 40 miles south of Baton Rouge. He left the job only a few days after the sinkhole emerged, and Vitter’s campaign has accused him of abandoning the Bayou Corne residents.

Energy Department Selects Five Projects In First Step To Produce Fresh Water From CO2 Storage Sites

WASHINGTON, D.C. ― Today, the Department of Energy announced the selection of five projects that will study the feasibility of using salty water―or brine ―from carbon dioxide (CO2) storage sites to produce fresh water.

These projects – which will receive more than $7 million in funding from the Department―will develop and validate strategies to manage pressure and the flow of CO2 in saline formations through a Brine Extraction Storage Test (BEST).

By managing the pressure and the flow of CO2―also known as a plume steering―brine can be extracted from the formation at specific points, where fresh water can be separated in a process known as enhanced water recovery (EWR).

NY TimesMethane Is Discovered Seeping From Seafloor Off East Coast, Scientists Say

Scientists have discovered methane gas bubbling from the seafloor in an unexpected place: off the East Coast of the United States where the continental shelf meets the deeper Atlantic Ocean.
The methane is emanating from at least 570 locations, called seeps, from near Cape Hatteras, N.C., to the Georges Bank southeast of Nantucket, Mass.  . . .

“The state had 109 temblors measuring 3.0 or greater in 2013 — more than 5,000% above normal.”

Obama is pals with BP:
HOUSTON – In the aftermath of the Deepwater Horizon disaster, BP fell from its perch as the biggest provider of jet fuel to the Department of Defense, barred from doing business with the federal government in late 2012.

On the Lake Peigneur saga –
The Daily IberianWaiting on Jindal: Governor’s signature all that’s needed for SB 585 About Lake Peigneur to become law

Senate Bill 585, which places a two-year moratorium on constructing solution-mined salt caverns in Iberia Parish, is awaiting Gov. Bobby Jindal’s signature after being sent to his office June 1 from the Secretary of the Senate.
“I’m anticipating a signature pretty soon,” said state Sen. Fred Mills, R-Parks, who pushed the bill through the House and Senate. “I think it’s just a matter of timing.”
Save Lake Peigneur President Nara Crowley said she is waiting until the bill is law before getting anything started, but she has been in contact with AGL Resources, the company hoping to construct two more Twin Tower-sized salt caverns beneath the lake. . . .
